High court: S.C. cities can ban smoking

The state's cities and towns have the power to ban smoking in all enclosed public places, including restaurants and bars, under an S.C. Supreme Court ruling released Monday. The smoking ban survived a challenge from dozens of Greenville business owners who claimed their city's ban was unconstitutional and local law should not pre-empt state laws. Those arguments were supported by a trial judge who ruled in favor of the business owners in March 2007. But the state's Supreme Court unanimously overturned that decision Monday, a move that could inspire more local governments to enact similar smoke-free zones and could pave the way for more discussions on a statewide smoking ban...
